European crosswalk and a guy walking his bike. Yeah. That's a definite yield. On the other hand, how do you mistake a motorcycle for a guy "walking" a bicycle? Driver was definitely doing something other than paying attention while driving.

This pedestrian sign has a yellow outline which is either Eastern European or Russian, and given the lack of blue on the plates I'd say this is in Russia. Still doesn't change the yield though you're right.

Adding to the old "drivers have to yield in crosswalks" discussion: Yes that's correct.

BUT it's in your own self-interest to pay attention to traffic before crossing to avoid getting flattened by someone not paying attention.

You also cannot expect cars to magically overcome the laws of physics by "surprise crossing" the line when cars are within inches of the crosswalk, not saying that's the case here but it happens a lot.

Here in Germany its a mutual. As a pedestrian you have to make sure you make yourself present and if cars in both directions are aware of you, you can cross. I accept that to be the same across all of Europe.

In the video, the direction of cam car was already stopped and the pedestrian with bike half way crossed, when distracted driver zoomed into the crosswalk. Absolute moron.

My parents taught me to look both ways before crossing the street. In the US, it's like lesson #2, right behind "Don't touch the hot stove".

Yeah, the driver was in the wrong, but there's no self-preservation going on there if you're a pedestrian and you assume drivers are going to stop.

Honestly a perspective from a country without pedestrians is really fucking useless, fix your traffic, lots, stroads, public transport, infrastacture and that bloated traffic related death rate, then come back and tell us the biker was in the wrong. A cross walk is for heavy foot traffic, crossing one without checking cross traffic is the same as blowing a stop sign in an intersection, with the little caveat that the driver risks the life of others instead of themselves. Also yes the guy with the bike had little awareness which is moronic but these crosswalks service the literally blind as well, putting the blame on anyone but the driver shows your American bias.

Denmark. Cars have the right of way over unregulated cross walk. The car dosent have to yield. Offcourse still without doing what happened in the video. If necessary the car will have to stop to let the pedestrian cross. But it dosent have have to yield.

This is incorrect, you should take a look at your handbook given when you took your licence. You must slow and yield if needed for a pedestrian who is on or about to cross the unregulated crosswalk.

"Den kørende skal om nødvendigt standse for at lade de gående passere." If you had to yield it would say vigepligt. But it dosent. Cars don't have to yield to people at crosswalks. STK 7 says to slow down to prevent a accident and if necessary you have to stop your car. It dosent say yield. Yield=vigepligt. You also don't get a handbook. Atleast i didn't.

To be honest I think both are equally at fault, cyclists came into street without any care for their own life, driver was going too fast and not paying attention, at least he tried to swerve. The follow up reaction is just pathetically insane.

That’s because, by doing so, all traffic is required to come to a complete stop and yield to them. Not only does the traffic need to stop, but they should slow in advance and have to actively look for anyone looking as if they intend to cross. Cycling across the crosswalk would have consequences for the cyclist.

I'm in the UK and we do stop at crossings here if someone is waiting (well 99% of us do). But when I was in Portugal I stopped at a crossing to let a mother with a pushchair across and she just looked embarrassed and waved at me to carry on. I guess they just wait for a large enough gap there and run for it.

Or it's just having respect for your fellow humans you ALSO live around. If you are "making" someone else wait and you don't need to, the respectful ones of us notice such things.

I've noticed something very interesting about human behavior at crosswalks...specifically because our city is phenomenally stupid with "pedestrian safety," having attempted to put almost 100% of all safety responsibility on vehicle drivers and remove it from pedestrians.

Quick rundown of what they did so you can understand: STATE LAW for crosswalks is that you must stop if someone is waiting to cross at one....you know, how it is MOST of the places in the world for crosswalks. Know what OUR city did? Made the law state that if you SEE a person simply APPROACHING the crosswalk you need to stop for them. This literally told pedestrians "you don't need to look when crossing." To no one's surprise we literally had TWO pedestrian fatalities in the first year, both caused when someone charged out into the crosswalk during traffic without even looking. You can look at pedestrian fatalities overtime going back decades here....you can clearly see an increase in fatalities when the new law took effect, and it continued to rise.

So yeah....back to what I've noticed about human behavior at crosswalks because we have A LOT of them and they are used. Some people will speed up their gait and walk a little faster if they are causing you to stop for them. OTHER people will slowdown as they cross so as to make you wait. Most people don't do either and are oblivious. I feel it is another social litmus test for folks, like putting your cart back at the market.

Just try to be the person that walks a little faster....cause you'll also be the person that sees and stops for the person waiting to use the crosswalk.

You can guarantee that if there is ever a video of a cyclist being hit, regardless of the circumstances, regardless of the laws, people will blame the cyclist.

You could have someone with a bicycle sitting on a park bench and a drunk driver who is texting with both hands off the wheel could blast over the sidewalk and through a fence to hit the cyclist and people will still say “Guy should’ve seen that coming and dodged, I don’t care about the laws, cyclists should be more aware.”

Which I find funny because if you took 90% of “cyclist getting hit and the driver is at fault” clips on the internet and just took away the bicycle, people would agree the driver is at fault. But nah since this guy owns a bike he deserves it.

This isn't really about cycling, though. He was just walking the bike across, so the same as being a pedestrian. I assume he had the right of way, so legally the cyclist is in the right, the driver's in the wrong. But it's incredibly stupid not to at least look both ways before crossing.

It's a crosswalk, but even 5-year-olds know that you look both ways before crossing, especially for a fast street like that one. The bicyclist didn't look at all.

EDIT: Legally, the biker (or really, pedestrian) has the right of way. I'm saying it's stupid to assume people will yield for you just because it's the law. There are a lot of idiot drivers out there. In that situation I would assume anyone driving up to that intersection is one of those idiots, and take the necessary precautions. Namely, stopping and waiting.

EDIT2: I guess I am victim-blaming in a way. But would you tell your child "you have the right of way, so just go. Don't bother looking left or right."? I would guess no on that one.

Not remotely what I said. I still follow the rules. I look for pedestrians. I let them pass if needed. I know the law and I respect it.

Doesn't change the fact that THE PEDESTRIAN should CHECK THE ROAD and not cross the damn walk like it's got some magical force field that makes them indestructible! It's in their best interest to be cautious. Why is that so hard to comprehend?

Some people don't want to live in fear. You can reasonably expect that cars don't want to hit you, so they slow down if they see you even if they didn't want to yield. And yes, it's risky, but who cares in certain situations? It's not black and white, some ppl won't always be afraid of cars.

Sometimes there are lights that you have to wait to turn red or green. And some other times there aren't traffic lights but yellow flashing lights that will start flashing when someone at the crosswalk hits a button indicating that it should be safe for them to walk and cars should be yielding. Sure, were not all from America but how do people not know about this?

I'm so paranoid thanks to numerous Crosswalk jumpers that I witness every day, that I wait for both the leading car and the one tailgating it to come to a stop. 😬

I've seen someone get pancaked because the tailgating vehicle didn't stop in time, dominoing the lead vehicle into the pedestrian (who had right of way.)

I also do as you say, making eye-contact with the driver and getting "permission" from the driver to cross. A simple "Hi, I see you" gesture is VERY comforting, haha

There are plenty of videos of it going poorly for the helmet wearer. If you’re not used to being in fights and you’re wearing a helmet fighting someone who is it’s a pretty big disadvantage. They’re a giant handle for your head, which means they can move you where they want you and hurt your neck in the process. Motorcycle helmets are also heavy enough they would make it harder to get off the ground quickly, and they reduce your hearing and peripheral vision.

I'm all about right of way, and that guy absolutely had the right to cross alongside his bike...

But personally, in a battle of Car Vs Flesh, I lose even if I (or my next-of-kin!) win the legal battle. So I'm that annoying Crosswalker who explicitly waits for all vehicles to be fully stopped complete with "permission" from the lead Vehicle Driver to cross. (In a sort of "Hi, I see you" confirmation.) 😅

Am I the only one who feels like the car was chasing/trying to stop the motorcyclist before accident? That would explain the speed and lack of attention on whats in front of the car, as well as the grabbing of the motorcylist.

Maybe roadrage, a thief, a hit and run or something along the lines. ¯_(ツ)_/¯

Even the if that car was chasing the motorbike for some reason, which he almost certainly wasn’t, it doesn’t change the fact that he was still driving recklessly and almost hurt someone.

And the reason he very much wasn’t chasing him is because that biker seemed to be in 0 hurry. If he was being chased by this crazy dude in a car he definitely wouldn’t have driven past him so close while going slower than a snail. He’s literally on a motorcycle, so he could have easily went past him by going around him properly and driving faster. I don’t see a world in which some regular dude in a car is able to cut a bike off or even overtake them on an open road like this.

Traffic actively moving, I’d say it’s the pedestrians fault for not looking both ways. the vehicle didn’t even have time to slow down. When I first watched it thought it would turn into an insurance fraud vid.

You should never walk into a crosswalk with a car approaching as fast as he was. Drivers don't expect people starting into their paths like that. The white car was almost on track to hit him too. You don't see his brake lights till the Volvo swerves

Cyclists genuinely should have waited. Obviously if a car is going 30mph like 10m from the crossing you have to wait as it is more dangerous for it to slam on the brakes so close to the crossing.

You can't just cross whenever. Use your brain 😂 proving a point is not worth risking your life for.

Always wait for cars to stop. End of.

Technically, on paper, is the cars fault though, because it is the law to stop at a crossing like that.

Driver is definitely at fault but can we acknowledge that the cyclists definitely did not take the appropriate opportunity to cross? Even ignoring the initial lane he has to cross the other lane the the video is taken from clearly has cars in it. Legally the driver is at fault but morally the cyclist could've used better judgement and this all could've been avoided.

No? The cyclist was well within their rights to cross there - you can see in the video that the white car had plenty of time to slow to a stop, and did so.

I'm not saying he didn't have the right to cross. I'm saying he should've used better judgement. Just because pedestrians have the right of way doesnt mean you should explicitly put yourself in a position to test people's awareness. Even with right of way you should always make sure the street is as safe as possible to cross

Not sure why you're getting downvoted. Why would you step out in front of a car that is right there without making eye contact with the driver or otherwise confirm that they're stopping for you? Reddit is way too black and white on stuff like this. Of course the cyclist has the right of way as a pedestrian, but surely you'd prefer not to get hit at all?

Pedestrians on a marked crosswalk gets right of way. It's legally required for the driver to stop. Driver gets most of the fault but the pedestrian should've been more aware imo.
