News Case Update: Formal Arraignment scheduled in PA for 1/24/2025.
Someone posted this but they deleted it! This will likely be over Zoom because LM is in NY in federal custody. This could also change, so take it with a grain of salt.

Right . Thatās all Iāll say he did have like 4 IDs but itās a lesser offense. Imagine he gets the state and federal charges dropped and he serves some time for the fake ID . In some other world lol

Police typically ask for identification when theyāre called for āsuspiciousā people (not saying he was suspicious thatās how the McDās worker saw him) however you donāt have to comply unless they have a search warrant which they had no grounds for. He wouldāve been better off saying sorry I donāt have my ID (which is believable and he wasnāt driving so he didnāt need to have his ID), said nope Iām not showing it, sorry (again you donāt have to show ID unless they have a warrant) or just giving them his real ID. Idk what he was thinking with the fake ID tbh because now he has several charges in PA on fraud alone which can be quite a hefty sentence.

All LM had to do was say he forgot his ID. If they kept asking questions, he didnāt have to answer. Itās not illegal to eat a hash brown.
I donāt fault him - one thing the Blacklivesmatter community taught me was my rights when approached by police.

He knew his rights. The general public population is believing that story from McDonalds, but there is no video, so I dont understand why. It is discussed if they found him through missing report or in McDonalds, I did never believe the McStory, there was no cash reward, there was no video, no proof, no nothing. He was just photographed in Donals, we have no other info, why he doesnt have his shoes on etc.

What's the sentence for using fake ID's in the U.S.? Is it that serious of an offense as in has jail time or only light sentences such as community service and such?

Although jail time is technically possible depending on the state, it's very rare for people to actually be sent to prison for that kind of crime if they have no prior serious criminal history. In that case it's much more likely they'll just be put on probation, have to pay fines, and/or do community service.

The 2nd page confirms that he did request a public defender before his family hired Dickey. So he initially wasnāt going to involve his family or reach out for their help which is sad but understandable.

If I remember correctly it was reported at the time he was extradited that any further court appearances for him in Pennsylvania would be done over zoom. Neither his lawyers, nor New York State or the feds will want him to be being transported back-and-forth, itās not practical and itās also a safety risk for all involved.
His lawyer will more than likely be there in person and heāll just zoom in to enter his plea.

It depends on which case they try first.
It looks like from the last hearing that the NY state case will be tried first since thatās where the suspected crime occurred (aka primary jurisdiction).
LM has not been indicted on federal charges yet, so weāll see.

Why would they have the trial over zoom if theyāre in nyc ? Itās only on zoom for the PA charges cuz itāll be a waste of resources to go to pa again

Meanwhile, where's the perp walk and interrogation and manhandling of that psycho Sebastian Zapeta? HE SET A WOMAN ON FIRE, but they didn't "make an example" of him like they did while parading around LM and shoving their thumbs in his neck. I guess if a rich CEO is unalived, it's more profitable than a 52 year old woman on a subway (and she's just one of many, many examples).
Will this be broadcast or streamed anywhere?

Iām honestly surprised theyāre going ahead with this, itās common for charges in other jurisdictions to be placed on hold if the defendant is in another jurisdiction for a more serious crime. An example of this would be the Lori Vallow/Daybell case where she had pending charges in Arizona waiting for her while her Idaho case moved through system as it was deemed more serious.
Although, I guess they need his plea on the recordā¦
It makes me wonder if they need the charges in PA to be able to bring it into his NY trials as prior bad acts? This case is so over complicated at this point.

The prosecutor would probably be allowed to elicit testimony regarding the offense if (1) LM were to testify and (2) he was convicted of the offense prior to giving his testimony in court. This is regardless of when the date of the alleged offense occurred in relation to the alleged offense he's testifying in trial for.
This is because (1) giving false id to law enforcement is a crime of dishonesty and (2) jurors are allowed to consider any witnesses' prior felonies or misdemeanor crimes of dishonesty in determining the credibility of the witnesses' testimony.
If LM does not testify, then it wouldn't be able to be elicited as testimony because jurors are not allowed to consider prior crimes of dishonesty in determining guilt itself. It is only allowed for the purposes of determine credibility of testimony.

Is anyone aware of the sentencing length for the PA charges? Like a fake ID couldnāt be very long but having a weapon (unless proven it was planted) could ⦠:(

Fake ID jn PA is just fines like 300 dollars or 90 days in jail . It also takes account into your criminal record . Jail time in such cases would be extremely rare, generally only being imposed for people with a lengthy criminal history. The normal punishment for a conviction is payment of fines and costs. And for the unlicensed gun itās a 1st degree misdemeanor can also be jail time 5 years or up to 10k in fines. This also takes into account into the persons criminal record

max ~25 years but it'll be max ~15 years bc no criminal record and first time offender. he'll get less if he pleads guilty.

ā for a gun without a permit, up to $15k and 7 years in prison (if it's deemed a felony).

I think sentencing in what they said they were going to wait until after the New York trial? But the Pennsylvania case is easier really because he was found with the unregistered gun on his possession and he presented the fake ID to the police so tried to falsely identify himself which is pretty much the main charges isnāt it?
Ultimately if he gets found guilty in New York the Pennsylvania charges are irrelevant anyway because heāll be getting life, they really only matter if his lawyers managed to pull a miracle and get him off in New York.

He was always going be charged in Pennsylvania as well because itās different charges to the New York ones, he was just extradited to New York because thatās where the most serious charges are and they take precedents.

Because itās gonna take time for the ny charges ? He legit has a federal case and state case against him .. the PA case is open and shut case . He presented a fake ID to law enforcement and was carrying a gun unlicensed ?

I agree- If he pleads guilty for a reduced sentence on say, the fake IDs, that could validate some of the evidence they supposedly found in his backpack.
That could impact his other cases, especially the Federal case- I do not like this!

Iām sure heāll plead not guilty in PA to not mess up the NY/Fed case, but good point. I wonder how much, if at all, Dickey and KFA are in communication over this. The cases are separate jurisdictions but hinge on the same evidence. What happens in one will impact the other. I canāt imagine trusting another lawyer to be on the same page on this but I guess itās the nature of the job

Exactly- so many cases is expensive but hopefully he doesnāt plea guilty, plea bargain or not. šš¾KFA knows better than us though, so letās trust her and Mr. Dickey.
This is how they get less privileged people to just take the wrap for whatever theyāre accused of- most people could not afford to pay multiple high powered lawyers in different jurisdictions.

You can poke holes in any proposed āevidenceā no matter how on point it appears to be. How was he searched? Did he consent to the search? Was this done securely to ensure that the weapon was not planted? A good defense attorney can poke holes in any evidence to create reasonable doubt.
My uncle was killed and the person literally left a letter admitting to the crime on top of the trash can he was stuffed in. The cops didnāt have a warrant to enter the house so all evidence, including the letter admitting guilt, was thrown out and the case was overturned in appeals court. We were beyond upset but cops mess up cases all the time. Itās called āfruit of the poisonous treeā.

He must have so much going round in his head, with all these charges from all different states and federal! Can anyone tell me what the next state court appearance is for on the 21st of Feb? If he has already had his plea hearing and plead not guilty to the state charges what will this one be for? Is this the start of the trial?

I'm not sure but I think it's called "motions", wherein they discuss, contest, and decide which items in discovery will actually be included and labeled as "evidences".
Not all items in discovery make it into evidences. For example, if the method of obtaining it is illegal or proven to be tampered with, no matter how incriminating, it will not be part of the evidences presented to the jury.

Kinda nervous because the judge served for the pd for many years before becoming a judge (I have nothing against police, there is just potential imo to side with his own), not much I could find about him other than this article:
He has mixed reviews as well. I believe in Tom Dickey though, so hope is not lost yet :)

You plea guilty or not guilty before you have a trial lol.
If you plea guilty, then you do not have a trial. If he takes a plea bargain, meaning he admits wrongdoing in exchange for a lower sentence in prison, then he doesnāt get a trial.

I literally forgot he also had the Pennsylvania hearing I feel like we all forgot is he gonna get another fly out? I hope he gets to go in person because itāll mean he can come outside for a bit. Itās baffling to me as a no American that you can be held in custody without being proven guilty. Now I donāt know if itās the same around the world. But it just sounds so unfair.
