Hard call. If you do this there’s a good chance you’re being fired for a reason but if you’ve just been fired after setting that up - and they knew they were going to fire you when they made you set this up - then yeah fuck them honestly.

It really is a tough call because I’ve had employers metaphorically fuck me like this.

It’s also hard, because even if justified, this may come back and bite her in the ass. Hotel can probably claim a few things and deduct salary or something.

In most states, if not all, they can't withhold pay. They would have to go to small claims or file a civil suit.

The way I look at it . . .

If it's a shitty restaurant and management is shit. It usually trickles from the top down.

I've learned that from 20+ years in the profession.

This is one of the rare cases they absolutely can take damage out of your paycheck in most states. It's basically about whether the employer can prove it was intentional. In the case of this post, it's pretty clear

On paper, sure.... in reality, even with video evidence, it's not worth their time to pursue and prove unless we are talking over 5k in damages. If they find that you were wrong for any reason, you're fucked.

This is criminal, though. You could get a vandalism charge. Spend a half-day in jail and get a misdemeanor on your record.

Plus, you are making work for your (former) co-workers. "Management" isnt mopping the floor to clean up the mess.

Deducting salary from last paycheck would be for things like not returning uniforms or laptops if you signed paperwork at hiring stating they could.

This lady probably didn’t sign anything stating they could deduct the damages from her obviously accidental slip and fall that resulted in the breakfast buffet getting, again very accidentally, destroyed.

yeah filming someone you know's just gotten fired and then they coincidentally do something outrageous is totally normal and not at all a set up.

Update since I keep getting replies on this about how I’m stupid for thinking this - a “set up” refers to positioning a camera for something you know is probably going to occur. Like if your coworker is an asshole or even if this was just some random firing up their camera because they’re incapable of minding their own fucking business like most people who post stuff like this.

It doesn’t mean I think it was faked, it means I think it could be premeditated. I don’t actually care if it was either.

It's not unreasonable that it's just a hotel guest who overheard her getting loud about being fired before she went over to the buffet. I'm sure there were some heated words exchanged with the employee and the manager shortly before the video starts.

Or:

Hotel guest hears angry person.

Hotel guest starts filming without knowing why the angry person is angry.

Hotel guest later finds out why this happened then adds text to the video.

Alternate option:

Someone made up a false reason and added that text to this video of an angry person, relying on the tendency of people to trust random text on the internet that has zero proof of that text being true.

I mean if right before the recording started, she yelled "I can't believe you're firing me after I just worked a graveyard shift!" Then yes absolutely they would know she was both fired and angry. Given her very public display, this does not seem out of the realm of possibility.
