Because the 1% who gets in trouble due to nonsensical laws is 1% too many.

Also because they enable pointless witch hunts. Eg: an adult had sex with a 17 year old, therefore they're a "pedophile". Meanwhile the 17 year old looks nothing like an actual child and more like a college student.

How about actually using critical thinking before farting out some nonsense and blindly believing contradictory laws.

My point is that a pedophile is attracted to actual children. Not 17 year old who look like a grown ass adult. I'm sure the pedo would just pass at that point.

Meanwhile a 15 year old can get charged as an adult for a crime, but in regards to anything sexual "their minds are just too young and impressionable".

until you hooked up with the 17 year old at a 19+ event, so you reasonably assume they were, you know, 19+. They used a fake ID and got past the bouncer. Guess what, you're fucked. Doesn't matter it was a 19+ event, doesn't matter they lied to get in, doesn't matter you had every reason to believe they were 19, INCLUDING them telling you as such. (recalling an article from a while back)

THAT's the problem. Somehow, I don't see other countries having these problems. Could be our much smaller population here in Canada, the UK, or France to name a few, or it could be crappy application and writing of laws.

Because unless you're psychic, you can't really tell if someone is lying to you. Being lied to does not equal a defense in court.

I can't find it for whatever reason, but there was a story a few years ago about a girl lying, and even showing a fake id. In the end despite seeing what appeared to be a valid id, the man was put on a sex offender list.

That was actor Rob Lowe. He met a girl in a bar. She took him home, had sex with him, and videotaped it on her parent's video camera (which the parents themselves used to record their own sex acts). The daughter's deed was found out when the parents went to watch one of their trysts and saw the daughter with Lowe.

During the investigation, it was revealed that the daughter had a fake ID good enough for her to get into any over 21 establishment in the country...didn't matter. Lowe went to jail and got on the list. Court said that "he should have known."

The law says its illegal to bang 16 year olds, not "16 year olds that don't show you ID". You've still got the mens rea to support a crime.

I'm assuming he's talking about people in the same age group and so are unable to tell the difference because, mentally, there usually isn't much of a difference (mentally) between a 17 year old and a 18-20 year old.

I see what you mean, but tbh even between a 17 and a 20 year old, there's quite some difference in average sexual maturity, mentally speaking.

They're 17, not 12. The whole point I'm trying to make.

There's no magical event that happens that gives someone common sense on their 18th birthday had it been morning a year prior.

There's no 17 year old walking around today oblivious of what sex is. I promise you.

Someone in their mid-twenties is more experienced and has more leverage to manipulate and hurt a 17/18 year old, especially sexually. There is a developmental gap that tips the power balance very disfavourably towards the teen. And the worst part is that late-teens are convinced that they're very mature and know what they're doing, which makes them get into harmful relationships like that.

There's no magical maturity tipping point where someone becomes immune to manipulation and abuse, we agree. BUT if you look at the averages, 16-18 y/o is young and unexperienced, while 23+ is more mature and self-defined. Which is why these age groups shouldn't mingle too much sexually.
